2024 CHICAGO FOOTBALL CLASSIC RAFFLE OFFICIAL RULES

The Chicago Football Classic, Inc. (“CFC”), a not-for-profit charitable organization, is conducting the raffle of a 2023 Jeep Rubicon 392 pursuant to the Illinois Raffles & Poker Runs Act, 230 ILCS 15/0.01 et seq. and the Chicago Municipal Code 4-156-060 et seq. to raise funds for ongoing charitable purposes. The Official Rules for the Raffle are set forth below. CFC shall be responsible for interpretation and application of the Official Rules, with such interpretation and application being final.

ELIGIBILITY

Persons who are at least 18-years of age may purchase a ticket to the Raffle. CFC employees, officers, directors, their spouses and children living in the same household are excluded from participating and are ineligible to win. All federal, state and local laws and regulations apply. The Raffle is void where prohibited.

HOW TO ENTER

Raffle tickets must be purchase from an authorized representative of the CFC. Each Raffle Ticket (a “Ticket”) is $100.00. If the name of more than one person is provided on the Ticket entry form and that Ticket is selected as the winning ticket, then the person named first shall be deemed the Ticketholder of that Ticket and declared the winner. The division of a prize among a group of persons purchasing a Ticket in common shall be sole responsibility of the Ticketholder should that Ticket be selected as a winner. CFC is not responsible for resolve any disputes which may arise from different individuals listed on a winning Ticket. By purchasing a Ticket, the purchaser acknowledges that he or she is aware of, and agreed to bound by, these Official Rules and CFC’s interpretation thereof.

Only 1,000 Tickets will be sold. Tickets may sell out any time.

All Ticket entries must include payment by valid check, money order or cash. CFC reserves the right to reject any entry that is submitted without proper payment. No refunds are available except at the exclusive discretion of CFC.

All Ticket entries must include valid contact information including name, mailing address, and telephone number. It is the purchaser’s responsibility to provide valid contact information.

Any defective or physically altered entry form or entry form received without proper payment will be immediately disqualified. Neither CFC nor its directors, officers, employees, agents or other representatives assume any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible, or undeliverable entries, or any other failure to receive entries prior to drawing deadlines.

PRIZE DRAWING

The prize drawing will be conducted by a representative of CFC. The winner will be selected at random.

The drawing will be held on or about September 21, 2024 at the 26th Annual Chicago Football Classic. At the option of CFC, the drawing date may take place sooner if all Tickets are sold prior to September 21, 2024.

If a minimum of 500 Tickets are sold by the end of the 3rd Quarter on September 21, 2024, then the winner of the drawing (the “Winner”) will receive a 2023 Jeep Rubicon 392 (the “Prize”). If fewer than 500 Tickets are sold by the end of the 3rd quarter on September 21, 2024, then the Winner will receive 50% of the total cash Ticket proceeds received by CFC minus all costs and expenses incurred by CFC in connection with the Raffle as full satisfaction of the prize. The sum of total cash proceeds less costs and expenses shall not exceed $25,000.

The Prize shall be transferred to the Winner AS IS, WHERE IS, AND WITH ALL FAULTS. CFC DOES NOT PROVIDE ANY WARRANTY, EXPRESS OR IMPLIED, IN CONNECT WITH THE PRIZE, AND ACCEPTS NO LIABILITY REGARDING THE CONDITION OF THE PRIZE. CFC DOES NOT WARRANT THAT THE PRIZE IS FREE FROM DEFECTS, OF MERCHANTABLE QUALITY, OR FIT FOR ANY PARTICULAR PURPOSES. NO EXPRESS WARRANTIES ARE GIVEN AND NO AFFIRMATION OF CFC BY WORKS AND/OR ACTIONS WILL CONSTITUTE A WARRANTY.

The Winner assumes all fees, local, state and federal taxes (including, without limitation, income taxes based upon the value of the Prize, and any other taxes) which must be paid at the time the vehicle is transferred to the Winner. CFC makes no guaranty that that the U.S. Internal Revenue Service (the “IRS”) will accept the value of the vehicle for purposes of determining any income tax that may be due from the Winner.

The Winner is solely responsible for any and all local, state and federal license, title or registration taxes or fees, insurance (proof of which must be provided prior to delivery of the Prize) and pickup or delivery fees associated with the Prize.

CFC may elect in its sole discretion to substitute the Prize for a vehicle of equivalent value. The Prize shall be delivered F.O.B. Chicago, Illinois.

NOTIFICATION OF WINNERS

The Winner will be notified according to the contact information provided to CFC at the time of Ticket purchase. If a Winner is unable to be contacted for a period of 10-business days from the date of the drawing, the Prize or its cash equivalent will be deemed to have been donated to CFC.

In order to collect any prize, a Winner must sign and deliver to CFC: (a) a sworn affidavit of eligibility in accordance with these Official Rules; (b) a completed IRS W-2G, Form 5754, or similar tax form, for tax withholding purposes, along with whatever amount of tax is due to the IRS; and (c) proof of identity satisfactory to CFC showing that the person claiming the prize is the same person named on the winning Ticket.

WINNING ODDS

The odds of winning the Prize depend upon the number of Tickets sold. If all 1,000 Tickets are sold, the odds of winning shall be 1 in 1,000.

NON-DEDUCTIBILITY OF TICKET PURCHASES

The IRS has taken the position that amounts paid for raffle chances are not gifts and consequently do not qualify as a deductible charitable contribution.

TAXES

THERE MAY BE FEDERAL, STATE AND/OR LOCAL TAX CONSEQUENCES OF WINNING THE PRIZE. ANY AND ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Each purchaser of Ticket(s) is advised to consult with her or her own tax advisor.

TERMS & CONDITIONS

Theses Official Rules cannot be changed by any oral statement of an agent of CFC. By entering the Raffle, entrants accept and agree: (1) to be bound these Official Rules and the decisions of CFC thereon which shall be final and binding; (2) waive any right to claim ambiguity in the Raffle or Official Rules; and (3) that CFC may use the entrant’s name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional purposes in connection with the Raffle on a worldwide basis and in all forms of media, now or hereafter known, in perpetuity, without review, permission, or further compensation, except where prohibited by law. The Raffle is void where prohibited by law.

BY ENTERING THE RAFFLE, EACH ENTRANT RELEASES CFC, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSES, OR OTHER DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEYS FEES) CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING THE PRIZE, OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. EACH WINNER AGREES TO INDEMNIFY, AND HOLD HARMLESS CFC FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

A RAFFLE ENTRANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST CFC ARISING OUT OF THE SALE OF A TICKET OR THE CONDUCT OF THE RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR THE TICKET. IN NO EVENT SHALL CFC, ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISE OF THE POSSIBILITY OF SUCH DAMAGES.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE RAFFLE OR THESE OFFICIAL RULES SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES AND CONDUCTED IN CHICAGO, ILLINOIS. THE JUDGMENT ON THE AWARD RENDERED BY SUCH ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

CANCELLATION

By purchasing a Ticket, each ticketholder acknowledges and agrees that CFC has the right, in its sole discretion, to elect not proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a ticketholder’s sole and exclusive remedy shall be to request and receive a receive a refund of the full price paid by such ticketholder for each ticket purchased, without interest.

REGISTRATION

CFC has registered with the City of Chicago Department of Business Affairs & Consumer Protection under Raffle License No. 2288753.
